A Hispanic man sentenced on drug smuggling charges
“I have been clear from the beginning of this case that my office would prosecute this drug smuggler when we had the evidence to prove his guilt,” stated U.S. Attorney Johnny Sutton.
“Thanks to the hard work of the agents of the DEA and DHS-OIG and federal prosecutors in my office, he is on his way to federal prison to serve the sentence that he so justly deserved.”
Appearing before United States District Judge Kathleen Cardone this morning, the defendant was sentenced to a total of 114 months in federal prison to be followed by 10 years of supervised release and a $400 special assessment. The sentencing breaks down as follows:
Count III: Possession with Intent to Distribute 100 Kilograms or More of Marijuana – 57 months, 5 years Supervised Release, $100 Special Assessment.
Count IV: Conspiracy to Import 100 kilograms or More of Marijuana -- 57 months, 5 years Supervised Release, $100 Special Assessment.
Counts III and IV are to run concurrently.
Count V: Conspiracy to Possess with the Intent to Distribute 100 Kilograms or More of
Marijuana -- 57 months, 5 years Supervised Release, $100 Special Assessment.
Count VI: Possession with the Intent to Distribute 100 Kilograms or more of marijuana – 57 months, 5 years supervised release.
Counts V and VI are to run concurrently.
This case was investigated by the Drug Enforcement Administration and the Department of Homeland Security Office of the Inspector General. It is being prosecuted for the government by Assistant United States Attorney John Gibson.
